Welcome to Delphyn AI. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit our website, create an account, or use our text-to-speech, batch voiceover, voice library, and voice cloning services (collectively, the Services).

By using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree with this policy, please do not use the Services.

1. Information We Collect

Account and contact information

When you register, sign in, or contact us, we may collect your name, email address, profile image, login credentials, authentication provider details, and the contents of communications you send to us.

If you sign in through a third-party account such as Google or GitHub, we receive the basic account information that you authorize that provider to share.

Content you submit

To provide voice services, we process content you choose to submit, including:

• text, scripts, batch documents, filenames, speaker assignments, voice selections, and generation settings;
• recordings and voice samples submitted for voice cloning or voice-related features;
• generated audio, project history, and related technical metadata; and
• support messages or feedback that may include content you voluntarily provide.

Voice recordings may be treated as biometric or sensitive data in some jurisdictions. Only upload your own recordings or content for which you have all necessary permissions and legal rights.

Payment and transaction information

Payments are processed by Waffo Pancake, our Merchant of Record. Waffo may collect your name, email address, billing address, payment method details, tax information, and other information required to process a purchase, manage a subscription, prevent fraud, issue refunds, and comply with financial or legal obligations.

Delphyn AI does not receive or store your complete payment card number. We may receive order identifiers, purchased products, payment and subscription status, currency, amount, refund status, and other transaction metadata needed to provide credits or paid features and maintain business records.

Usage, device, and log information

We may automatically collect information such as your IP address, browser and device type, operating system, language, referring page, pages visited, feature interactions, timestamps, crash information, and other diagnostic or security logs.

Cookies and similar technologies

We use cookies and similar technologies for authentication, security, language and interface preferences, service operation, and—where enabled—product analytics. Essential cookies are required for functions such as signing in and protecting accounts. You can manage or delete cookies through your browser settings, although disabling essential cookies may prevent parts of the Services from working correctly. Where required by applicable law, we will request permission before using non-essential analytics technologies.

2. How We Use Information

We use information to:

• create and secure accounts and keep users signed in;
• provide text-to-speech, batch generation, voice selection, voice cloning, downloads, project history, and related features;
• process purchases, subscriptions, credits, refunds, and account entitlements;
• operate, maintain, troubleshoot, secure, and improve the Services;
• provide customer support and respond to privacy requests;
• send transactional messages, such as account, security, payment, and service notices;
• understand feature performance and usage trends;
• detect abuse, fraud, unauthorized access, and violations of our terms; and
• comply with applicable law, tax, accounting, and legal obligations.

We do not sell your personal information. We do not use your private scripts, voice samples, or generated audio to train our own general-purpose AI models unless we first obtain separate permission from you.

3. Legal Bases for Processing

Where applicable law requires a legal basis, we process personal information because:

• it is necessary to provide the Services or perform a contract with you;
• it is necessary for our legitimate interests, such as service security, fraud prevention, support, and product improvement;
• you have provided consent, which you may withdraw where applicable; or
• it is necessary to comply with a legal obligation.

4. How We Share Information

We share information only as reasonably necessary for the purposes described in this policy, including with:

• Fish Audio, which processes submitted text, voice references, generation settings, and related data to provide voice generation and voice cloning functions;
• Waffo Pancake, which acts as Merchant of Record and an independent controller for payment, billing, tax, fraud, compliance, refund, chargeback, and transaction data;
• hosting, database, and file-storage providers, including services used to host Delphyn AI, store account and project records, and deliver generated audio;
• Resend or other email delivery providers for account and service communications;
• PostHog or other analytics providers when analytics is enabled, to help us understand and improve use of the Services;
• authentication and security providers, such as optional Google or GitHub sign-in and anti-abuse or captcha services;
• professional advisers, auditors, insurers, or authorities where reasonably necessary; and
• a successor or buyer in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to appropriate confidentiality protections.

We may also disclose information when required by law, legal process, or a valid government request, or when reasonably necessary to protect users, enforce our agreements, investigate fraud, or protect the security and rights of Delphyn AI and others.

Third-party providers process information under their own terms and privacy policies. In particular, purchases made through Waffo are also subject to the Waffo Privacy Policy.

5. Data Retention

We retain personal information only for as long as reasonably necessary to provide the Services, fulfill the purposes described in this policy, resolve disputes, enforce agreements, and meet legal, tax, accounting, security, and fraud-prevention obligations.

Account and project data may be retained while your account is active. You can delete your account from the Security settings or contact us for assistance. Deleting an account may remove or anonymize associated content, but limited records may be retained when required or permitted by law. Data may remain temporarily in protected backups until those backups are rotated or deleted.

Payment and transaction records may be retained by Delphyn AI and Waffo for longer periods where required for tax, accounting, chargeback, fraud, or other compliance purposes.

6. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, loss, misuse, alteration, or disclosure. However, no method of transmission or electronic storage is completely secure, and we cannot guarantee absolute security.

You are responsible for keeping your password and account credentials confidential and for promptly notifying us if you suspect unauthorized account activity.

7. International Data Transfers

Delphyn AI and our service providers may process information in countries other than the country where you live. Data protection laws in those countries may differ from those in your jurisdiction. Where required, we use appropriate safeguards for international transfers.

8. Your Privacy Rights

Depending on your location, you may have the right to:

• access or receive a copy of personal information we hold about you;
• correct inaccurate or incomplete information;
• request deletion of personal information;
• object to or restrict certain processing;
• request data portability;
• withdraw consent where processing is based on consent; and
• lodge a complaint with a competent data protection authority.

You can review or update certain account information in your settings and delete your account from the Security page. For other requests, email nicolabosho@gmail.com from the address associated with your account and describe your request. We may need to verify your identity before completing it. Some rights are subject to legal exceptions.

9. Children's Privacy

The Services are not directed to children under 13, or a higher minimum age where required by local law. We do not knowingly collect personal information from children who are not legally permitted to use the Services. If you believe a child has provided us with personal information, contact us so we can take appropriate action.

10. Third-Party Links

The Services may contain links to websites or services that we do not control. Their privacy practices are governed by their own policies, and we are not responsible for their content or practices.
